Terms & Conditions

The use of the web site (the “Web Site”) is subject to the terms and conditions stated herein. Use of the Web Site constitutes an agreement by you (the “Client”) that your use is governed by these terms and conditions. In addition, when using particular Pumadventure Peru & Tours services, you will be subject to any guidelines or rules applicable to such services that may be posted from time to time.

THE CONTRACT BETWEEN THE CLIENT AND PUMADVENTURE PERU & TOURS

1.- To secure a booking with Pumadventure Peru & Tours, we require 50.00% of the total amount at booking, and the remaining 50.00% when you arrive to Peru before the initial date of the trip.  In case of a cancellation, please refer the cancellation policy further below.  The deposit less the money already expended on subcontracted services may be used toward future travel with Pumadventure Peru & Tours. Clients booking by telephone, facsimile or email will be deemed to have read the booking conditions.

2. – A booking is accepted and becomes definite from the date Pumadventure Peru & Tours has received the client’s deposit and personal information. It is at this point that a binding contract between Pumadventure Peru & Tours and the Client comes into existence.

3. – The contract is between Pumadventure Peru & Tours and the Client, being all persons named on the booking form. The person signing the booking form, warrants that he/she has full authority on behalf of all the persons whose names appear thereon, and confirms that all such persons are fully aware of and accept these conditions.

4. – Each booking (including optional tours), confirmation, reduction, extension, or modification must be made/sent to:

Number of adults and children (under 11 years) and toddlers (under 1 year)

Starting and ending dates of the trip

Destinations:  Lima, Cusco & Sacred Valley & Machu Picchu, Paracas & Nazca Lines, Arequipa & Colca Canyon, Lake Titicaca & Puno, jungle program, etc.

Hotel category (3, 4 or 5 stars) and room type (single, double with 1 full/queen/king-size bed, double with 2 twin size beds, triple)

International means of arrival and departure to Peru (airlines and flight numbers) and schedules

A member of Pumadventure Peru & Tours will respond to the Client’s request within one or two working days.

5. – In case of tour cancellations, the Client must send his/her request solely to:

Starting and ending dates of the trip

A member of Pumadventure Peru & Tours will respond to the Client’s request within two working days via email, including a cancellation code.

 

 

 

PAYMENT

 

1. –  For Independent Travelers, the balance of all monies due must be paid to Pumadventure Peru & Tours no later than 30 days before departure. For Groups, 50% of the balance of all monies due must be paid to Pumadventure Peru & Tours no later than 60 days before departure and the remaining balance when you arrive to Peru.

2. –   In the case of late bookings (those made within 30 days of the departure date). Full payment of the balance is immediately.

3. – Payment can be made by credit card or transferring the total amount of the invoice to one of our accounts. In case of a bank transfer all wiring and transfer costs should be assumed by the Client.

CHANGES BY THE CLIENT

Any changes to the original booking must be confirmed by the person signing the booking form. Any costs or charges, which we incur or which are incurred or levied by our suppliers as a result of the amendment, will be charged to the Client. Whilst every reasonable effort will be made to accommodate changes and additional requests, their availability cannot be guaranteed.

SUBSTITUTIONS OF CLIENT

If any member of your party is prevented from traveling, it may be possible to transfer the booking to another suitable person, provided that written notice is given at least 30 days prior to departure. An administration fee of US$ 40 will be levied plus any costs imposed by Pumadventure Peru & Tours suppliers. Airlines may impose 100% cancellation charges and the cost of a new ticket.

CANCELLATION BY THE CLIENT

The Client may cancel the booking, including optional tours, at any time provided that the cancellation is communicated to Pumadventure Peru & Tours in writing. Cancellation charges will be applied as shown below calculated from the day written notification is received by Pumadventure Peru & Tours. In addition to the charges shown below airlines may impose 100% cancellation charges.

All cancelled reservations are subject to a cancellation fee. The cancellation fee is a percentage of the tour price according to the number of days before departure on which the written notification is received.  The percentage is based on the cancellation policies of the service providers included in the quote.  The following fees apply for cancellations:

For Independent Travelers:

0 – 29 days prior to arrival: 100% of total cost

30 – 59 days prior to arrival: 25% – 50% of total cost

60 – 89 days prior to arrival: 10% – 25% of total cost

For Groups:

0 – 29 days prior to arrival: 100% of total cost

30 – 59 days prior to arrival: 50% of total cost

60 – 89 days prior to arrival: 25% of total cost

In case part of a booking is cancelled, the remaining party may have to pay additional charges (e.g. under-occupancy, or single room supplements).

 

CHANGES AND CANCELLATION BY PUMADVENTURE PERU & TOURS

While Pumadventure Peru & Tours will use its best endeavors to operate all tours as advertised, by entering into this contract the Client accepts that it may prove necessary or advisable to vary or modify a tour itinerary or its contents due to prevailing local conditions. Pumadventure Peru & Tours reserves the right at any time to cancel or change any of the facilities, services or prices (including flights, accommodation or other arrangements) and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment as a result of these changes.

If a major change is known to us, the Client will be told at the time of the booking.

If a major change becomes necessary after booking Pumadventure Peru & Tours will inform the Clients as soon as reasonably possible.

When a major change is made the Client will have the choice of accepting the change of arrangements, purchasing any other available tour or canceling the tour and obtaining a full refund.  Provided that the major change is not because of force majeure.

Force majeure is war, threat of war, riots, civil strife, industrial dispute, terrorist activities, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, changes imposed by cancellation or rescheduling of flights by an airline, the alteration of airline or aircraft type, or other similar events beyond the control of Pumadventure Peru & Tours.

Pumadventure Peru & Tours is not liable for any charges in the event of a change -beyond their control- to the departure time or date of a tour, flight or other form of transport.

PASSPORT, VISA AND VACCINATIONS

It is the responsibility of the Client to be in possession of a valid passport, visa permits, inoculations and preventive medicines as may be required for the duration of the tour. Information about these matters items is given in good faith but without responsibility on the part of Pumadventure Peru & Tours.

AGE, FITNESS AND PARTICIPATION

All Clients are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their choosing. Persons over 60 years of age will be advised to obtain medical evidence of fitness to travel on the chosen itinerary. No unaccompanied minors (those under 18 years of age) can be accepted on tours operated by Pumadventure Peru & Tours, however older teenagers may be considered provided they are accompanied by a parent or guardian who accepts full responsibility for them. Pumadventure Peru & Tours reserves the absolute right to decline a booking at their discretion. Clients agree to accept the authority and decisions of Pumadventure Peru & Tours’ employees, tour leaders and agents, whilst on the tour with Pumadventure Peru & Tours. If in the opinion of such person the health or conduct of a Client before or after departure appears likely to endanger the safe, comfortable or happy progress of a tour, the Client may be excluded from all or part of the tour. In case of ill health Pumadventure Peru & Tours may make such arrangements as it sees fit and recover the costs thereof from the Client.

LOCAL LAWS

All participants in tours operated by Pumadventure Peru & Tours are expected to obey the laws and regulations of the countries visited and any failure to do so will relieve Pumadventure Peru & Tours of all obligations that they may otherwise have under these booking conditions.

ILLNESS OR DISABILITY

Anyone suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the tour. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the tour in which case all monies paid will be forfeit.

IF THE CLIENT HAS A COMPLAINT?

If the Client has a complaint about any of the tour arrangements he/she must bring it to the attention of the tour leader or other representative of Pumadventure Peru & Tours  at the time so that they may use their best endeavors to rectify the situation. It is only if Pumadventure Peru & Tours is made aware of any problems that there will be the opportunity to put things right. Failure to complain on the spot will result in the Client’s ability to claim compensation from Pumadventure Peru & Tours being extinguished or at least reduced. Should the problem remain unsolved a complaint must be made in writing to Pumadventure Peru & Tours within 28 days of the completion of the holiday.

OUR RESPONSIBILITY

Pumadventure Peru & Tours  cannot guarantee the accuracy of any hotel, resort or other leaflet which is not published by them but may be supplied as an additional service to the Client.

Pumadventure Peru & Tours accepts responsibility for ensuring that the holiday which the Client books with them is supplied as described in the final version of the travel program the Client will receive upon arrival and the services reach a reasonable standard.

Pumadventure Peru & Tours  acts only in the capacity of an agent upon the legal conditions that, while exercising every possible precaution, it is not responsible for injury, sickness, damage, loss, additional expenses, accidental delay, or other irregularities which may be caused either through willful or negligent acts or omissions made by the companies or individuals providing or engaged in transportation, accommodation or other services related to the accomplishment of the tour, or through natural disasters, social upheavals or other causes.
